TOPEKA — The Kansas State Department of Education has issued advice to school districts in response to the U.S. Department of Homeland Security’s reversal of a policy prohibiting immigration authorities from making arrests on school property. President Donald Trump rescinded guidelines limiting enforcement actions near “sensitive” areas, including schools. The new policy has raised concerns, prompting KSDE to remind schools to comply with laws protecting student rights and safety.

Director of communications Denise Kahler emphasized that the federal policy shift doesn’t change state or federal law. Schools are advised to update emergency contact information for families and not share student information without consent or a court order. KSDE operates under the Supreme Court decision in Plyler v. Doe, ensuring equal protection for all students regardless of immigration status. It was reported that 1.6% of Kansas students lack residency documents.

The impact of the policy change also raises questions for healthcare facilities. The University of Kansas Health System is evaluating the implications on their services. Acting Homeland Security Secretary Benjamine Huffman stated the directives are aimed at protecting Americans from criminals hiding in sensitive areas. The Trump administration trusts law enforcement to use common sense in enforcement actions.
